Thank you for accessing www.safferyrotarywalk.org.gg (“the Website”). Please read these terms and conditions before using the Website.

By using the Website, you signify your acceptance of these terms and conditions in consideration of which we provide you with access. From time to time we may modify these terms and conditions so please continue to review them whenever accessing or using the Website. If at any time you do not wish to accept the Terms, you may not use the Website. From time to time we may run competitions and promotions via the Website. Separate terms and conditions will be posted where applicable governing such competitions and promotions.

  1. While we have endeavoured to ensure the accuracy of information on the Website, we do not guarantee or give any warranty as to the accuracy, timeliness or completeness of any information or material on the Website. The Website and the Content are provided, “as is”, without any warranties of any kind unless specifically stated. Please note that some jurisdictions do not allow the exclusion of implied warranties, so some or all of the above exclusions may not apply to you.

All articles, reports and other elements making up the Website may be copyright works. You acquire no rights or licences in or to the Website and/or the Content other than the limited right to use the Website in accordance with these terms and conditions and to download no more than one copy of the Website for your personal, non-commercial use.

  4. The Website, amongst other things, may contain certain discussion forums, bulletin board services, chat areas and/or other message or communication facilities (collectively, “Communities”). Much of the content of the Communities, including the content within a specific message or posting, is provided by and is the responsibility of the person posting in that Community. We have no responsibility for such content and are merely providing access to such content as a service to you.

  5. We reserve the right to terminate or restrict your access to the Website at any time without notice for any reason whatsoever.

  6. You acknowledge that access to the Website is provided free of charge. If you are dissatisfied with the Website, these terms and conditions or any of the Content your sole remedy is to discontinue use of the Website. Save in respect of fraud and of personal injury or death to the extent it results from our negligence, we accept no liability to you whatsoever whether based on warranty, contract, tort (including negligence) or otherwise. Applicable law may not allow the limitation or exclusion of liability for consequential or incidental damages, so this limitation or exclusion may not apply to you.

  7. The Website is not directed at any person in any jurisdiction where for any reason the publication or availability of the Website is prohibited. Those in respect of whom such prohibitions apply must not access the Website. We do not represent that either the Website or the Content are appropriate for use or permitted by local laws in all jurisdictions. Those who access the Website do so on their own initiative and are responsible for compliance with applicable local laws or regulations; legal advice should be sought in cases of doubt.

  9. You agree by using the online registration process that your participation in the Saffery Rotary Walk s entirely at your own risk. Whilst the Walk organisers endeavour to make the Walk as safe as possible anyone participating in this event accepts that they do so at their own risk. Neither the organisers nor the owners of any property or land on or adjacent to the walk takes any responsibility for any loss of or damage to any property or injury to or death of any person whether caused by a negligent act, omission or wilful misconduct.

The Terms are governed by the laws of Guernsey and the parties submit to the exclusive jurisdiction of the Guernsey courts.

Privacy Notice

1.    INTRODUCTION

The Saffery Rotary Walk (hereinafter “we”, “us”, or “our”) promises to respect the confidentiality of any personal data you share with us, to keep it safe, and we will always take every effort to protect your privacy.

We pride ourselves on our honesty and openness and will always be clear how, when and why we collect and process your information; we promise we will never do anything with your details that you wouldn’t reasonably expect.

2.    COLLECTION OF INFORMATION

We collect information in the following ways.

When you give it to us DIRECTLY

There are many ways you may give us your information. For example, when you sign up to the walk, communicate with us either by phone, in writing, including email or in person. We are responsible for your data at all times.

When you give it to us INDIRECTLY

Your information may be shared with us by independent organisations. These independent third parties will only share your information when you have consented. You should check their Privacy Notice when you provide your information to understand fully how they will process your data.

Via Social Media

Depending on your settings or the privacy notices for social media and messaging services like Facebook, WhatsApp, LinkedIn or Twitter, you might give us permission to access information from those accounts or services.

Via information available publicly

This may include information found in places such websites and information that has been published in articles/newspapers.

Like most websites, we use “cookies” to help us make our site, and the way you use it, better. We do not store any personal data in the cookies that we use.

3.    DATA THAT WE HOLD

3.1 Business Contacts

What personal information we collect and how we use it

We will only ever capture the minimum amount of information that we need to in relation to your donation or sponsorship and we promise to keep your information secure. The personal data we will usually collect is:

  • Your name

  • Your contact details

  • Your photograph

  • We may also ask for additional information

How we will use your data

We will use your personal data for the legitimate interest of conducting core business activities, these will include:

  • Administer your sponsorship, or invitation to events, or to provide a service

  • Communicating organisational messages and information

  • To present on our website or social media

  • In any other way we may describe when you provide the information

  • For any other purposes with your consent

Sensitive information

We do not collect any personal information on businesses classified as ‘sensitive’ under GDPR or Data Protection (Bailiwick of Guernsey) Law, 2017.

3.2 Service User Contacts

What personal information we collect and how we use it

  • Your photograph

  • We may also ask for additional information to assess the service need

  • Provide a service

  • Communicating messages and information

  • To present on our website or social media

  • In any other way we may describe when you provide the information

  • For any other purposes with your consent

Sensitive information

We may need to collect physical or mental health or condition personal information on service users classified as ‘sensitive’ under GDPR or Data Protection (Bailiwick of Guernsey) Law, 2017. This information will only be collected for people taking part in an event where we, as the event organiser, processing is necessary to protect the vital interests of the individual. This information will be held securely and only passed to relevant parties e.g. St John Ambulance, and appropriately destroyed/deleted after the event.

Children

We need to process children’s data in relation to participating in the walk.

Where the child is 13 or over they are able to provide their own consent, for children under this age consent will be sort from whoever holds parental responsibility for the child.

The same data processes, safeguards and rights are in place for children’s data and information will be appropriately deleted/destroyed after the event or service has been delivered.

4.    DATA SHARING

Our service/host providers

In the course of our legitimate business activities, there may be a need for us to share, or give access to, your personal data to third parties that provide us with services or host our applications/software that you may access. We will ensure that data processing agreements, compliant to GDPR and Data Protection (Bailiwick of Guernsey) Law, 2017, are in place before sharing with, or giving access to, your data with any of our service/host providers.

Sharing with third parties

We will never commercially sell your personal data to anyone else.

We will only ever share your personal data in other circumstances, not listed above, if we have your explicit and informed consent at the time of collection. However, we may need to disclose your details if required to the police, regulatory bodies or our legal advisors.

How we keep your information safe and who has access to it

We ensure that there are appropriate physical and technical controls in place to protect your personal details. We undertake regular reviews of who has access to information that we hold to ensure that your personal information is only accessible by appropriate walk volunteers and our service/host providers.

We have a duty to report certain types of personal data breaches to the relevant supervisory authority, and where feasible, we will do this within 72 hours of becoming aware of the breach. If a breach is detected and likely to result in a high risk of adversely affecting you, we will inform you without undue delay.

Where we store your information

Your personal information will be hosted securely within Guernsey, the UK or the EU.

How long we retain your information and how we keep it up to date

We will only keep your information for as long as we need it to assist you with your event registration or other services associated with the walk. There are statutory timescales on how long we should keep your information. We shall delete your information according to these statutory limits, or according to guidance issued by the Data Protection Commissioner.

5.    INDIVIDUAL’S RIGHTS

  • You have a right to be informed when your personal data is being collected, what is collected and how it will be used or

  • You have a right of access to your personal data: the right of access allows you to be aware of and verify the lawfulness of the processing of your personal data. You can also request a copy of the information which we hold on you. This information will be provided free of charge, unless the request is found to be manifestly unfounded or excessive then a reasonable fee will be charged. The application should be made in writing, by letter or email, and addressed to the Saffrey Rotary Walk Secretary, enclosing two proofs of

  • You have a right in certain circumstances to have inaccurate personal data rectified, blocked (restrict processing), erased (right to be forgotten), or

  • You have a right in certain circumstances to object to the processing of your personal data for such reasons as direct marketing, automated decision making, profiling; although we can confirm we make no decisions on you using an automated

  • You have a right in certain circumstances to data

In certain situations, these rights may not apply, for example if you are taking part in the walk we need to communicate with you in relation to the event, in which case you will not be able to unsubscribe from these communications.

Changes to this privacy notice

We may change this privacy Notice from time to time. If we make any significant changes in the way we treat your personal information we will make this clear on our website or by notifying you directly.
